Copyright Information

It is the policy of the University Libraries of the University of Nevada, Las Vegas to follow the fair use provisions of the Copyright Law (contained in Title 17 of the U.S. Code). Specifically, the University Libraries Reserves Policy is guided by the permissions granted within Section 107 of the Copyright Law with respect to making copies for educational purposes. In essence the law states that making multiple copies for classroom use is not considered a copyright infringement. It further establishes four factors that will be used to determine whether the use being made of a work is fair use:

• Purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
• The nature of the copyrighted work;
• The amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
• The effect of the use upon the potential market for or value of the copyrighted work.

In the enforcement of photocopying works for the purpose of placing them on reserve, the University Libraries complies with these four fair use factors and to that end adheres to the following requirements:

• Reserves will be processed for UNLV courses only.
• All materials placed on reserve will be at the initiative of faculty solely for the non-commercial, educational use of UNLV students.
• Material will be made available for the semester the class is being taught.
• Electronic sound reserves will only be made available for the semester the class is taught, and only to students who are actively enrolled in that class. Access to these reserves is by course-specific password only.
• There will be no charge for access to reserve materials. The charge for copies made by students will be limited to the nominal costs of photocopies ($0.10/page - black and white only), or computer print-outs ($0.02/page - black and white only). A RebelCard or Rebel Guest Card is required for all photocopies and/or computer printouts.
• Electronic sound reserves may not be copied, dubbed, or downloaded.
• Materials requested for reserves that are not owned by the library will be purchased when possible. However, personal copies of sound recordings not owned by the library will not be placed on electronic sound reserve.
• Whether the library owns the item or not, photocopies or sound recordings of the following items will not be put on reserve/electronic sound reserve:
  • An entire book;
  • An entire journal issue;
  • Amounts that exceed the essence of the work;
  • Materials intended to be purchased by students for course work, such as textbooks, coursepacks, workbooks, exercises, sound recording anthologies, solution manuals, standardized tests or test booklets and answer sheets, and case studies; and
  • Student papers without written permission from the author granting such permission and waiving privacy rights.
• A copyright notice will be placed on all photocopies to be used for reserve material.
• UNLV faculty are responsible for making the initial good faith determination of fair use and acknowledging copyright compliance when making requests to place items on reserve.
• UNLV faculty are responsible for obtaining copyright permissions when needed, paying copyright permission fees as requested and presenting proof of copyright permission for items requiring such permission.
• Works that explicitly grant permission to copy for educational purposes will be accepted for reserves.
• The University Libraries reserves the right to:
  • determine if material will be placed on reserve; and
  • make the final determination if copyright permission is necessary.

The University Libraries will routinely monitor the effectiveness of this policy and make every effort to ensure that library services are in compliance with the Copyright Law.

Placing Items On Reserve

• To expedite the processing of your reserve materials, you may campus mail or email any of the Music Library Staff with a list of the items required so that pages and/or recalls may be placed as needed to complete your request. However, items cannot be processed until a signed Reserve Materials Received Form (PDF) has been received. The general turnaround time for processing of new reserves is 1-2 working days. During high-volume periods (such as the first two weeks of the semester), processing may take a bit longer.
• To request that sound recordings be placed on electronic sound reserve, use the Electronic Reserves Request Form (PDF). Only selections originating on compact discs may be placed on electronic sound reserve at this time. If the entire compact disc is not to be placed on electronic sound reserve, be sure to indicate track numbers for the selections desired. The compact disc for any sound recording requested for electronic sound reserve will also be placed on reserve concurrently with the electronic sound reserve files; this will be done automatically.
• To request that print materials be placed on electronic reserve, use the Electronic Reserves Request Form (PDF). You must submit 8-1/2 x 11 photocopies only, free of stapes, not folded, dog-eared or tattered, and without black borders or dark pictures (these will dramatically increase the file size, and thus the download time for users). Avoid shading over text, as this will cause the text to be blacked out when scanned. If multiple-page items result in large file sizes, these may be split into multiple files to avoid long download times.
• For personal copy items, please indicate on the Reserve Materials Received form in the Special Instructions space if you wish to have your items returned to you via campus mail when they are removed, or if you would prefer to pick them up in person. Personal copies of sound recordings will not be placed on electronic sound reserve.

Circulation Policy

• All media materials (CDs, DVDs, Video Cassettes, Audio Cassettes, LPs, and Mini-Discs), Music Reference, and other non-circulating materials may only be placed on reserve for a 2-hour in-house use only. This applies to personal copy items as well as those items owned by UNLV. All students and faculty must use these items in-house.
• Students may not use Music Library computers to listen to electronic sound reserves but will instead be expected to use the physical copies when in the Music Library.
• Print materials (Books, Scores, Syllabi, Journal Articles, etc.) may be placed on reserve for 2-hour in-house use only, 24-hour checkout, 3-day checkout, or 7-day checkout. This applies to personal copy items as well as those items owned by UNLV.
• Only the faculty/GTA who has requested an item for reserve may remove the item for use outside the Music Library. Exceptions may be made if the faculty/GTA that wishes to use an item contacts the faculty/GTA who placed the item on reserve and arranges with them to use the item for a specific day and/or time. The faculty/GTA who placed the item on reserve must contact one of the Music Library staff via phone or email to verify the exception prior to checkout. If an item is placed on reserve by more than one faculty/GTA permission of all is required for the item to be removed from the Music Library.

Removing Items from Reserve

• All items will be removed from reserve the first working day following the completion of Final Exams for the current semester unless otherwise specified.
• If you wish to remove an item from your reserve prior to the specified date, contact one of the Music Library Staff via phone or email to request the removal of items.
• Once items have been removed, if in-person pickup of personal copy items has been requested, items will be kept on the hold shelf for one week, unless other arrangements for pickup have been made with the Music Librarian. If items have not been picked up after one week or by the date arranged with the Music Librarian, they will be sent to the appropriate Department Office via the campus mail.
